These Privacy Terms and Conditions (collectively the “Privacy Policy,” or “Agreement”) explains how MF Consulting LLC, MinaFies.com and its affiliates and partners (collectively “MF”, “we”, “us”, or “our”), handles your personal information and data. This Privacy Policy is hereby incorporated by reference into our Terms of Use (“Terms of Use”). Capitalized terms not defined in this Privacy Policy are defined in the Terms of Use. Please read this Privacy Policy before using the Platform or the Services or submitting any personal or other information to MF. By submitting your information to MF, you acknowledge that you have read, understood, and agreed to be bound by the terms of this Agreement. This Privacy Policy may be changed at any time, and we encourage you to review this Privacy Policy whenever you visit the Platform to make sure that you understand how any Personal Information (as defined below) that you provide will be used. MF is committed to protecting the privacy of its users. Because MF collects certain types of information about the visitors to the Platform, we believe users should fully understand the terms and conditions surrounding the use of the information we collect. The statements below disclose our information collection, use, and dissemination practices for the Platform.  MF subscriptions are intended for single user accounts, but if you are using the Platform through a business, organization, educational institution or affiliate the terms and conditions of this Agreement still applies.  Please read the terms of any privacy policies that you enter into with parties other than MF as those policies may also explain how those parties use your personal information and may differ from those of the MF.

Collection of Your Personal Information

We collect information as part of operating our Platform and the Services.

In connection with the creation and maintenance of an Account, we may ask you to provide personal information, such as your e-mail address, name, home or work address, telephone number, etc. We may also ask for demographic information, such as your zip code, age, sex, preferences, interests, or profession.

In order to access the Platform, you will be asked to sign in to your Account with an e-mail address and password. You are solely responsible for keeping your password confidential. By signing in on the Platform, you will be able to access all components of the Platform and Services: including Forums, history, blog, user group discussion, community forums, chat information, message boards and download website(s). We may also ask users for information about how you use the Platform and Services.

We use technologies, such as cookies and web beacons (described below), to collect information about the webpages users view, the links users click, and other actions users take on the Platform.

We also collect additional information about users’ interactions with the Platform and Services without identifying users as individuals. For example, we receive certain standard information that a user’s browser sends to every website for a user’s visit, such as browser type, IP address, browser language, and access times. We also use website analytics tools on the Platform to retrieve information from a user’s browser, including the site the user came from, the search engine(s) and the keywords users used to find our site, the web pages users viewed, user browser plug-ins, and user browser’s set width and height. In addition, certain non-personal information regarding users is recorded by the standard operation of internet servers hosting the Platform. This information is primarily used to provide users of the Platform with an enhanced online experience. As set forth below, MF may disclose aggregated user statistics in order to describe the Platform or Services to prospective partners, investors, and agents, and for other lawful purposes. This information better provides us with aggregate data that we use to improve the Platform and the Services.

Purpose of Data Collection

MF requests personal information for purposes such as the provision of customer service and support, billing, network management, sales management, technical support, user memberships, event registration and other exchanges of information.

Additionally, in connection with the establishment of an Account, you may be required to provide certain information to a third-party payment processor (collectively “Third Party Processor”), including but not limited to credit card or other financial account information, and your billing address (collectively referred to herein as “Processor Information”). We are not liable for any harm or damages related to the Processor Information, or any other transactions made with or information given in connection with the Third Party Processor. You should direct any complaints, claims, concerns, or questions regarding the Processor Information to the Third Party Processor.

Use of the Data Collected

We also use personal information to communicate with users. We may send certain mandatory service communications such as welcome letters, billing reminders, information on technical service issues, and security announcements. Additionally, with user’s permission, we may also occasionally send users product surveys or promotional mailings to inform users of other products or services available from the RR and its affiliates. Users can opt-out from receiving this information at any time by clicking the unsubscribe link at the bottom of any communication, or by following the steps as described in the respective e-mails.

Aggregated Personal Information

In an ongoing effort to better understand and serve the users of the Services, we may gather customer demographics, interests and behavior based on the personal information and other information provided to us. This research may be compiled and analyzed on an aggregate basis, and we may share this aggregate data with its affiliates, agents and business partners. We may also disclose aggregated user statistics in order to describe our services to current and prospective business partners, and to other third parties for other lawful purposes.

We will not sell your disaggregated personal information. We will only disclose personal information when we believe in good faith that disclosure is reasonably necessary to (i) comply with legal process, (ii) enforce the Terms of Use, (iii) respond to claims that any content provided by using minafies.com violates the rights of third parties, (iv) protect the rights, property, or personal safety of MF, the Platform, its users, or the public, (v) protect against or prevent actual or potential fraud or unauthorized transactions, (vi) investigate fraudulent or harmful conduct that has already occurred, or (vii) in the event of any reorganization, merger, sale, joint venture, assignment, transfer or other disposition of all or any portion of MF or its affiliates.

We also utilize other companies to provide limited services on our behalf, including but not limited to customer support, web analytics, video streaming, coordination of mailings, and event management, etc.  These companies are permitted to access only the information they require to perform those services. We require these companies to maintain the confidentiality of any personal information and prohibit them from using the information for any other purpose than the purpose for which it was provided.

Personal information collected on the Platform or in connection with the Services may be stored and processed in the United States or any other country in which we or our service providers maintain facilities. We abide by the U.S.-EU Safe Harbor Framework and the U.S.-Swiss Safe Harbor Framework as set forth by the U.S. Department of Commerce regarding the collection, use, and retention of data from the European Economic Area, and Switzerland. Access to the Data Collected

We offer users the ability to correct or change the information collected during Account registration. Users may change this information at any time and as often as necessary by choosing the “Account” option in “Settings” or other similar functionality offered on the MF registration web pages.  To access or change user’s personal information, log-in to the user account through the Platform.  For data and information not available through such an account, please contact us at the address listed below.

Collection and Use of Children’s Personal Information

As more fully set forth in the Terms of Use, the Platform and Services are intended for general audiences to adults over 18 years of age and we do not knowingly collect any personal information from children. When the Platform does collect age information, and users identify themselves as under 18, the site will block such users from creating an account.

Please note: Granting consent to your child to access your Account is a violation of the Terms of Use and this Agreement. Further, if you grant consent for your child to use the Platform using your account login credentials, this allows the user access to such general audience communication services as e-mail, user group discussion, forums, video streaming, message boards and other online groups, and user’s child will be able to communicate with, and disclose personal information to other users of all ages. Parents or Guardians should not share their login credentials at any time to children under 18 years of age.

Security

We are committed to protecting the security of users’ personal information. We use a variety of security technologies and procedures to help protect users’ personal information from unauthorized access, use, or disclosure.

For example, we store the personal information we collect on computer systems and servers with limited access, which are located in secure controlled facilities. When we transmit highly confidential information (such as a credit card numbers or passwords) over the Internet, we protect it through the use of encryption, such as the Secure Socket Layer (SSL) protocol.

Use of Cookies

The Platform uses “cookies,” which are small text files placed on your hard disk by a web server. Cookies contain information that can later be read by a web server in the domain that issued the cookie to you.

One of the primary purposes of cookies is to store user preferences and other information on your computer in order to save user time by eliminating the need to repeatedly enter the same information and to display your identity, personalized content, preferences, and interests as related to the Platform and Services.

When users sign in to a site using their Account, we store users’ unique ID numbers, and the time user signed in, in an encrypted cookie on user hard disk. This cookie allows users to move throughout the website(s) without having to sign in again on each page. We also use cookies to improve the sign-in experience. For example, users e-mail addresses may be stored in a cookie that will remain on user’s computer after user signs out. This cookie allows user e-mail address to be pre-populated, so that user will only need to type user password the next time user signs in. If users are using a public computer, or do not otherwise want this information to be stored, you can select the appropriate radio button on the sign-in page, and this cookie will not be used.

Users have the ability to accept or decline cookies. Most web browsers automatically accept cookies, but users can usually modify your browser setting to decline cookies. If user chooses to decline cookies, user may not be able to sign in or use other interactive features of the Platform and Services.

Use of Web Beacons

The MF web pages may contain electronic images known as ‘Web Beacons’, or sometimes called ‘single-pixel gifs’, that may be used to assist in delivering cookies on our sites and allow us to count users who have visited those pages. We may include web beacons in informational e-mail messages in order to determine whether messages have been opened and acted upon.

MF may also employ Web Beacons from third parties in order to help us compile aggregated statistics regarding the effectiveness of the operations of our sites. We prohibit Web Beacons on our sites from being used by third parties to collect or access your personal information.

Miscellaneous

  • Terms of Use. This Privacy Policy is part of our Terms of Use. Any dispute over privacy is subject to this Privacy Policy and our Terms of Use.
  • Transfer of Information. In the event that we are involved in a bankruptcy, merger, acquisition, reorganization or sale of assets, your information may be sold or transferred as part of that transaction; however, the promises in this Privacy Policy will survive the transfer to the new entity.
  • Change of Terms. We may change this Privacy Policy at any time, without prior notice to you. If you access or use the Platform or Services, and such change is posted, you accept that change. If you do not accept the change, please do not access or use the Platform. You should check this Privacy Policy each time you use the Platform.
